Keeping Employee Contributions May Be Criminal

An employer deducted funds from employees' paychecks that were intended to pay for health and retirement benefits. The funds were never forwarded to the benefit plans, however. The Employee Retirement Income Security Act (ERISA) imposes civil penalties for mismanagement of plan assets, but was the employer's conduct criminal? The Seventh Circuit thought so.

HIPAA And Flexible Spending Accounts

The federal Health Insurance Portability and Accountability Act of 1996 (HIPAA) has rather complex privacy rules that many employers must follow. Those rules govern the use and disclosure of employees' "protected health information" (PHI).
