Massachusetts Workers' Compensation Rules and Requirements
Coverage Requirements
Massachusetts requires all employers with one or more employees to carry workers' compensation insurance. There is no minimum employee threshold, so coverage is required as soon as the first worker is hired (mass.gov). This applies broadly to:
- Full-time employees
- Part-time employees
- Seasonal and temporary workers
- Minors
- Most corporate officers and LLC members (unless properly excluded)
Employers Required To Carry Coverage

Coverage is required for:
- Employers with 1+ employees
- Private businesses and nonprofits
- Out-of-state employers with workers in Massachusetts
- Most industries including construction, retail, healthcare, and services
Common Exemptions
Some individuals may be excluded or treated differently:
- Sole proprietors (unless they elect coverage)
- Partners in a partnership
- Certain corporate officers (may be eligible to exclude themselves with proper filing)

Benefits Available

Covered employees may receive:
- Medical treatment (doctor visits, surgery, prescriptions)
- Weekly incapacity benefits (wage replacement)
- Permanent and partial disability benefits
- Vocational rehabilitation services

- Funeral expenses in qualifying cases
Wage Replacement
Generally 60%–two-thirds of the employee’s average weekly wage

- Obtain approval from the Massachusetts Department of Industrial Accidents (DIA)
- Provide required security or bond

Penalties For NoncomplianceEmployers without required coverage may face:
